New regulation on management and use of condominium

On 15 February 2016, the Ministry of Construction promulgated Circular No. 02/2016/TT-BXD on management and use of condominiums (“Circular 02”). As such, Circular 02 applies to condominium associated with residential, mixed use, and other purpose as set forth under the Law on Housing No.65/2014/QH13, including:

  1. Condominium for commercial use purpose;
  2. Condominium for social use purpose;
  3. Condominium for relocation purpose;
  4. State-owned condominium  are renovated and reconstructed.

Circular 02 covers the following matters: prohibited acts of using condominium and handling violation against rules on management and use of condominium; (iii) use ofcommon area of condominium; (iv) repair of damaged and changed equipment in private area of condominium; and (v) fire safety in condominium; (vi) obligations of the owner or user of condominium.

Circular 02 takes effect from 2 April2016 and replaces Decision No. 08/2008/QD-BXD dated 28 May 2014 and Circular No. 05/2004/TT-BXD dated 9 May 2014.
